These Terms of Service ("Terms") govern your access to and use of Haven Coliving's website, services, applications, membership, and facilities. Please read these Terms carefully before accessing or using our services.
Acceptance of Terms
By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services. These Terms constitute a legally binding agreement between you and Haven Coliving regarding your access to and use of the services.
Membership Eligibility
To be eligible for membership with Haven Coliving, you must:
- Be at least 18 years of age
- Complete our application process
- Pass our background and credit checks
- Provide accurate, current, and complete information
- Agree to comply with our community guidelines and house rules
- Sign the required membership and lease agreements
We reserve the right to deny membership to any applicant at our sole discretion, subject to applicable laws prohibiting discrimination.
Membership Terms and Payment
Term and Renewal:
Membership terms are specified in your membership agreement. Most memberships are month-to-month or for a defined period (e.g., 3, 6, or 12 months). Memberships automatically renew for the same term unless terminated in accordance with the notice period specified in your membership agreement.
Fees and Payment:
You agree to pay all fees associated with your membership, including but not limited to:
- Application fee
- Security deposit
- Monthly membership fee
- Amenity access fees (if applicable)
- Late payment fees
- Cleaning or damage fees (if applicable)
Payment Method:
You authorize us to charge the payment method on file for all fees due under these Terms and your membership agreement. You are responsible for keeping your payment information current and for any fees assessed by your financial institution.
Late Payments:
Payments received after the due date specified in your membership agreement are subject to a late fee. Continued non-payment may result in termination of membership and eviction proceedings in accordance with applicable law.
Use of Facilities and Services
Access and Use:
As a member, you are granted access to:
- Your private living quarters as specified in your membership agreement
- Common areas and amenities as designated for your membership level
- Community events and programming
Restrictions:
You agree not to:
- Use the facilities or services for any illegal purpose
- Damage, deface, or modify the property without permission
- Conduct business activities without prior written approval
- Create unreasonable noise or disturbances
- Smoke inside the building or in non-designated areas
- Store hazardous materials or illegal substances
- Violate community guidelines or house rules
- Grant unauthorized access to non-members
Guests:
You may have guests in accordance with our guest policy, which limits the frequency and duration of guest visits. You are responsible for your guests' compliance with these Terms and our community guidelines. We reserve the right to refuse entry to any guest at our discretion.
Termination of Membership
By Member:
You may terminate your membership by providing written notice within the timeframe specified in your membership agreement (typically 30 days). Early termination may result in fees as outlined in your membership agreement.
By Haven Coliving:
We may terminate your membership with notice as specified in your membership agreement for reasons including but not limited to:
- Non-payment of membership fees
- Violation of these Terms, community guidelines, or house rules
- Conduct that threatens the safety, wellbeing, or experience of other members
- Providing false information in your application
- Any illegal activity on the premises
Effects of Termination:
Upon termination of membership, you must vacate the premises by the specified date, remove all personal belongings, and return all access credentials. Your security deposit, less any deductions for damages or outstanding fees, will be returned in accordance with applicable law.
Website and Online Services
Account Security:
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or other security breaches.
Acceptable Use:
When using our website or online services, you agree not to:
- Violate any applicable law or regulation
- Infringe upon the rights of others
- Use automated means to access or collect data without our permission
- Attempt to gain unauthorized access to our systems
- Transmit malware or other harmful code
- Interfere with the proper functioning of our services
Intellectual Property
All content, features, and functionality of our website and online services, including but not limited to text, graphics, logos, designs, and code, are owned by Haven Coliving or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our materials without our prior written consent, except for your personal, non-commercial use.
Disclaimer of Warranties
Our services and facilities are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that our services will be uninterrupted, error-free, or free from harmful components, or that any defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law, Haven Coliving and our officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of our services or facilities.
In no event shall our total liability to you for all claims exceed the amount you paid to us for membership services during the twelve (12) months preceding the event giving rise to the liability.
Indemnification
You agree to indemnify, defend, and hold harmless Haven Coliving and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in connection with your violation of these Terms, your use of our services, or your violation of any rights of another.
Dispute Resolution
Any dispute arising out of or relating to these Terms or your use of our services shall be resolved through:
- Informal negotiation – We encourage you to contact us first to seek an informal resolution.
- Mediation – If negotiation is unsuccessful, the parties agree to mediate the dispute before a neutral mediator in Los Angeles County, California.
- Arbitration – If mediation is unsuccessful, the dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
Governing Law
These Terms and your use of our services shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Los Angeles County, California.
Changes to Terms
We may modify these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes your acceptance of the modified Terms.
